Buyback Surgeon LLC
Terms and Conditions
Last updated: September 24, 2026
These Terms and Conditions (“Terms”) govern your use of the device-buyback services provided by Buyback Surgeon LLC (“Buyback Surgeon,” “we,” “us,” or “our”) and your submission and sale of phones and other electronic devices (“devices”) to us. “You” means the individual or business submitting an order.
By accepting these Terms and submitting an order, you agree to the procedures described below, the condition requirements presented for your selected device, and any additional terms expressly agreed to for your order. Our Privacy Policy explains how we collect, use, and disclose personal information.
Important: These Terms include automatic acceptance of revised offers after seven calendar days without a response and a separate 30-day procedure for certain unclaimed devices, which may result in transfer without payment. Read Sections 8 and 10 before submitting your order.
1. Eligibility and Account Information
You must be at least 18 years old, legally capable of entering into a binding agreement, and authorized to sell each device submitted. A parent or legal guardian must complete the transaction for a minor and have authority to sell the device.
Our standard service is available to customers in the United States. Orders originating outside the United States require our approval before shipment.
If you act for a business, you represent that you have authority to bind that business and sell its devices.
Provide accurate and current information, including your name, email address, telephone number, shipping address, payment details, and device information. Keep any account credentials secure and notify us of unauthorized use. We may request reasonable evidence of identity, ownership, or authority to verify a transaction.
2. Ownership and Device Eligibility
You must own each device or have authority from its lawful owner to sell it. Devices must be free of liens and other claims that prevent you from transferring ownership.
We do not purchase devices that are financed, have unpaid carrier balances, are leased or rented, or are lost or stolen. We do not purchase counterfeit devices.
Carrier status must match the quote. A carrier lock is not the same as an activation lock or unpaid balance. A carrier-locked device may qualify where that status is disclosed and an applicable quote is offered. Devices locked to a foreign network are not accepted.
Remove all activation locks, personal accounts, passwords, and organizational restrictions before shipment. This includes Apple Activation Lock, Google account protection, and mobile-device-management or remote-management restrictions.
Submitting a device does not cancel your financing, service, insurance, or other obligations, and we do not assume those obligations.
3. Device Conditions and Valuation
Your device must match the model, storage capacity, carrier status, and condition selected in your order. Review the detailed condition descriptions shown during the quote process. Those descriptions form part of your offer.
Fully functional devices: Unless the selected condition expressly allows a defect, the device must operate normally, including its display, touchscreen, buttons, cameras, charging, microphones, speakers, connectivity, and other applicable features. It must have no cracked display, rear glass, or camera lens, defective display areas, bent housing, or liquid damage. Include its battery and any accessories specifically required by the quote, including a charger for a wearable when required.
Flawless: The device must be like new with no signs of use, fully functional, free of cracks, scratches, scuffs, or other marks, and clear for activation. Battery health must be above 95% where measurable.
Used conditions: The device must meet the cosmetic requirements of the selected category and remain fully functional unless that category expressly permits a defect. Battery health must be above 80% where measurable, unless the selected category requires a higher percentage.
Faulty or damaged conditions: The actual defect must be permitted by the selected category. Unless we approve otherwise in writing, the device must include its battery, remain intact, and contain all internal components. Crushed devices, bent devices, and devices snapped in half require approval before shipment.
Sealed or new devices: Where this category is offered, the device must satisfy the packaging, seal, and accessory requirements displayed with the quote.
Known repairs, replacement parts, parts warnings, engravings, missing components, and other permanent modifications should be disclosed. These may affect eligibility or value. A damaged-device category does not cover every possible defect or authorize shipment of an unsafe battery.
We determine our purchase offers based on the device’s verified condition and relevant market factors. Changes to published condition descriptions do not retroactively change the requirements accepted for an existing order.
4. Quotes, Price Guarantee, and Bulk Orders
All offers are in U.S. dollars. Prices for new orders may change without notice.
Your device must be received at our designated receiving location within 14 calendar days of your order date to qualify for the initial price guarantee. The order date may appear as the “Order Approved” date in your confirmation. Printing a label or shipping within 14 days does not satisfy a receipt deadline.
The guarantee applies only when the device matches the information submitted and meets the quoted requirements. Our inspection taking place later does not invalidate timely receipt.
Devices received after the guarantee period may be revalued at current prices. A different offer will follow the revised-offer procedure. Reminders do not extend the guarantee unless we confirm an extension in writing.
Orders containing two or more devices require our approval before shipment. A written bulk-order agreement may provide different pricing or shipping arrangements.
We are not obligated to match another company’s offer or adjust a completed purchase because prices later change.
5. Shipping and Packaging
We provide a prepaid USPS shipping label for eligible orders. Unless separately approved, a standard free-label shipment may contain no more than two quoted devices. The bulk-approval requirement still applies.
Use each label only for the associated order. Do not reuse labels or include unapproved items.
Follow our shipping instructions and the carrier’s requirements. Use a sturdy box, adequate cushioning, and packaging that prevents movement and accidental activation. Keep your tracking number and obtain a carrier acceptance receipt when possible.
Do not send unnecessary accessories or packaging. Include only devices and accessories requested or included in the quote.
Do not use our standard label to ship a swollen, leaking, damaged, defective, or recalled battery. Contact us before attempting shipment. All shipments must comply with applicable battery, hazardous-material, packaging, and transportation requirements.
6. Shipping Risk and Insurance
Except where we expressly agree otherwise for a collection we arrange, you bear the risk of carrier loss or damage during shipment to us until delivery to our designated receiving location, subject to applicable law and available coverage.
Once received, we will exercise reasonable care in storing, inspecting, and handling your device.
For a return, we will use reasonable packaging and a trackable service. To the extent permitted by law, carrier-transit risk passes to you when we properly package and tender the correctly addressed return to the carrier. We remain responsible for loss caused by our own improper packaging, labeling, or handling.
A prepaid label does not guarantee coverage for the device’s full quoted value. Coverage depends on the shipment, carrier, and applicable policy. Contact us before shipping a high-value device to confirm coverage and discuss additional insurance.
Notify us promptly of suspected loss or damage, and retain relevant receipts, photographs, and packaging. We will reasonably assist with claims involving labels we provide. Carrier coverage limits do not eliminate liability we independently owe under applicable law.
7. Inspection and Testing
After receipt, we inspect devices to verify their identity, condition, functionality, battery health, account restrictions, carrier status, financing status, and IMEI or ESN status. If the device qualifies for the original quote, your order authorizes us to complete the purchase at that price.
You authorize reasonable diagnostic testing, charging, software restoration, and data erasure needed to evaluate and process the device. Screen protectors, cases, or other removable coverings may be removed during inspection.
We will explain material findings that change the offer. Available inspection photographs or additional details may be requested from support.
Inspection and payment processing are separate steps. Processing estimates shown on our website or in your order information are estimates unless expressly stated to be guarantees. Verification issues, account restrictions, carrier delays, or incorrect information may require additional time. We will communicate material delays.
8. Revised Offers and Automatic Acceptance
If your device differs from its description, arrives after the price-guarantee period, or otherwise does not qualify for the original offer, we may email you a revised offer explaining the reason and revised amount.
You have seven calendar days from the revised-offer email to accept, decline, ask questions, or dispute the findings. The email will identify the response deadline.
If you accept, we will issue payment using your selected method. If you decline, we will arrange a return under Section 9.
By accepting these Terms, you authorize us to treat a revised offer as accepted and issue payment at that revised amount if you do not respond within seven calendar days. This applies only to positive-dollar offers for devices we may lawfully purchase.
A timely question, dispute, or return request pauses automatic processing while we address it. We will communicate any renewed response deadline before resuming that process. We will not rely on a notice we know was not received, including an email returned as undeliverable.
Devices with no buyback value or unresolved eligibility issues are handled under Section 10, not as automatic positive-dollar purchases.
Each device in a multi-device order is evaluated separately. You may accept or decline each revised offer independently. A return of one device does not cancel an authorized purchase of another.
9. Returns and Return Fees
If you decline an ordinary condition-based revised offer within the response period, we will return the affected device without a return-shipping charge, except as described below.
Free return shipping does not apply when:
- The device was significantly misrepresented.
- The device is reported lost or stolen, subject to lawful handling requirements.
- The device has an unresolved activation or account lock.
- The device has a bad ESN, financed IMEI, unpaid balance, or comparable restriction making it ineligible for purchase.
The fee is $20 for the first device subject to a return fee, plus $5 for each additional device subject to a return fee in the same shipment. Devices qualifying for free return do not increase that charge.
We will explain the applicable exception and fee. An ordinary good-faith disagreement about cosmetic condition does not, by itself, constitute significant misrepresentation.
Returns are sent to the address associated with your order unless a change is verified before dispatch. You are responsible for providing a correct address.
We are responsible for returning devices and accessories expressly included in the quote. We cannot guarantee return of unquoted items such as cases, screen protectors, original boxes, extra chargers, or earbuds. SIM cards are not returnable.
Returns remain subject to applicable ownership, law-enforcement, and shipping restrictions.
10. Unclaimed Devices, Reuse, and Recycling
If a device cannot be purchased because of an unresolved account lock, no buyback value, or another eligibility issue, we will email you an explanation, available options, any applicable return fee, and a response deadline.
You have 30 calendar days from that notice to resolve the issue, arrange a return and any applicable payment, or authorize reuse or recycling sooner. Before relying on nonresponse, we will send a final reminder at least seven calendar days before the deadline.
By accepting these Terms, you authorize us, to the extent permitted by applicable law, to treat the device as surrendered without payment if you do not respond or arrange its return within that period. Upon expiration of the period and completion of required notices, you agree to transfer to Buyback Surgeon the ownership rights you may lawfully transfer for reuse or recycling.
Reuse or recycling may include refurbishment, resale of the device, sale or recovery of components, material recovery, or disposal. It does not necessarily mean physical destruction. Where ownership has lawfully transferred under this section, we may retain the device or sale proceeds without further payment to you.
A timely question, dispute, or return request pauses this process while we address it. If return arrangements subsequently remain incomplete, we will provide a new written notice and deadline before relying on this section. We will not rely on a notice we know was not received.
This section does not authorize us to take third-party property, dispose of devices subject to ownership disputes or legal holds, bypass financing interests, or avoid payment of an accepted positive-dollar offer. Lost or stolen devices are handled under Section 14.
Any additional notice, holding, reporting, or disposition requirements imposed by applicable law control over this section.
11. Ownership Transfer and Cancellation
Submitting an order authorizes us to receive and evaluate the listed devices. The initial quote remains subject to inspection and these Terms.
For a paid purchase, ownership transfers when we receive and approve the device, the final price is accepted expressly or through Section 8, and we issue payment using the agreed method. A failed or rejected payment does not discharge our obligation to pay the agreed price. Transfers for reuse or recycling are governed by Section 10.
You may cancel without an administration fee before shipping. After shipment, cancellation is available through the revised-offer procedure or by our written agreement, subject to applicable law.
Once a purchase or authorized reuse or recycling transfer is completed, we may refurbish, resell, process, or otherwise lawfully dispose of the device. The transaction is final except as required by law or agreed in writing, and we cannot guarantee recovery of the device.
12. Payments
Payment is issued after inspection, approval of the applicable offer, and resolution of necessary ownership or payment verification.
Available payment methods and limits are displayed during checkout. Depending on availability, methods may include PayPal, paper check, Amazon Gift Card, Zelle, or another expressly offered method.
PayPal: Payment is sent to the PayPal details you provide. You are responsible for any applicable receiving fees disclosed for that payment arrangement.
Paper check: A check is mailed to the address provided. Issuance, postal delivery, and availability of funds are separate events. Contact us about a missing or returned check so we can verify its status and arrange an appropriate replacement.
Amazon Gift Card: An electronic gift card is sent to the email address supplied. The issuer’s redemption terms apply. Confirm your choice before issuance because an issued gift card may not be convertible to another method.
Zelle: Payment is sent using the supplied email address or mobile number associated with an account able to receive it. Enrollment or bank restrictions may delay payment.
You are responsible for accurate payment information and authority to receive payment. We may request verification when seller and recipient details differ. We cannot guarantee recovery of a payment sent to incorrect details supplied by you, but remain responsible for our own errors.
If a selected method is unavailable or exceeds a disclosed limit, we will contact you to arrange an alternative. We will not substitute a gift card without your agreement.
Unclaimed or undeliverable payments will be handled under applicable unclaimed-property requirements, not retained merely because they remain unclaimed.
13. Personal Data, SIM Cards, and Services
Before shipment, back up information you want to keep, remove personal accounts and activation locks, and erase personal data where possible. Remove physical SIM cards and memory cards, and transfer or remove eSIM profiles as appropriate.
Do not send passwords or security credentials. A nonfunctional device or passcode does not guarantee that stored information is inaccessible.
Inspection and processing may permanently erase information, including on devices ultimately returned. We do not provide backup or data-recovery services and are not responsible for restoring data erased through procedures you authorized, except as required by law.
We will use reasonable safeguards when handling devices containing personal information. Where a device is transferred to a third party with remaining data, that party must agree to erase the data before further use or resale. Nothing in these Terms excludes obligations imposed on us by privacy or data-security law.
You are responsible for cancelling or transferring service plans, subscriptions, and insurance. Selling your device does not cancel these arrangements or related charges. SIM cards received with devices are not returnable.
14. Lost, Stolen, and Subsequently Restricted Devices
We may check device identifiers against available databases and request proof of ownership. We do not knowingly purchase or pay for lost or stolen devices. We may pause processing to investigate an ownership concern and cooperate with lawful requests from law enforcement or other authorized parties.
Your representations about ownership, financing, and eligibility remain applicable after payment. You must not knowingly submit a false lost-or-stolen report, insurance claim, or account restriction concerning a device sold to us.
If a device later becomes restricted because of an undisclosed pre-existing obligation, an unauthorized sale, or a false report attributable to you, we may provide supporting information and seek resolution. To the extent permitted by law, you are responsible for actual, documented losses caused by your breach or fraud, accounting for any amounts or value we recover.
You are not responsible under this section for restrictions caused by us or a subsequent owner. We will not deduct a disputed loss from an unrelated order without your agreement or another lawful basis.
15. Pricing and Technical Errors
We may correct genuine typographical, catalog, pricing, or technical errors identified before payment. If a correction affects your order, we will explain it and present the corrected offer for your acceptance.
If you have already shipped the device, you may accept the correction or request a return. Return shipping is free when the return results solely from our error. We will not treat silence as acceptance of a correction made solely under this section.
This provision does not permit ordinary market-price changes to override a valid price guarantee or permit repricing after payment.
16. Electronic Communications and Optional Texts
You agree to conduct the online transaction electronically and receive order records and notices at the email address supplied. Maintain a working email address and check for our messages, including messages filtered to spam. Keep copies of these Terms and your order records.
Contact support to update your information, request copies, or discuss withdrawing electronic consent. Withdrawal does not invalidate completed transactions or eliminate outstanding obligations. We will not rely on a notice we know was not received to trigger automatic payment or disposition.
If you separately opt in to text updates, you consent to order-related messages, including automated messages where applicable. Message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help, or contact support. Text consent is not required to sell a device. Agreement to these Terms alone does not enroll you in marketing texts.
17. Website Use and Intellectual Property
Use our website and services lawfully. Do not submit fraudulent orders, misuse shipping labels, impersonate others, attempt unauthorized access, distribute harmful software, or use automated tools to disrupt the service or evade restrictions. These rules do not prohibit integrations we authorize.
We may restrict access for suspected fraud, security threats, or material violations. Restrictions do not eliminate our obligations concerning devices or payments already entrusted to us.
Our website content, branding, and software belong to Buyback Surgeon or their respective owners. Except as permitted by law, do not reproduce or commercially exploit protected content without permission. You may retain copies needed for your transaction records.
18. Third Parties and Website Disclaimers
Carriers, payment services, comparison websites, and other third parties operate under their own terms. We do not control their independent services or statements, and they cannot change your agreement with us without authorization. Their involvement does not eliminate obligations we undertake in these Terms.
To the extent permitted by law, our website and general informational content are provided on an “as available” basis without a guarantee of uninterrupted or error-free access. These disclaimers do not override an agreed purchase price, a valid price guarantee, or other express transaction obligations.
19. Liability and Seller Responsibilities
To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential losses, including anticipated resale profits, lost business opportunities, or business interruption arising from use of our services.
For an individual device transaction, our aggregate liability is limited, to the extent permitted by law, to the agreed purchase price or, where no price has been agreed, the device’s reasonable market value in its actual condition when received.
These limitations do not reduce an agreed payment obligation or exclude liability for fraud, gross negligence, reckless or intentional misconduct, or liabilities and remedies that applicable law does not permit us to limit. Nothing here disclaims a nonwaivable duty of good faith or reasonable care.
To the extent permitted by law, you agree to reimburse us for reasonable, documented losses and third-party claims caused by your fraudulent conduct, unlawful submission of a device, or material breach of your ownership representations. This does not require you to reimburse losses caused by our own misconduct. Legal fees are recoverable only where permitted by applicable law or a valid agreement.
20. Events Outside Our Control
We are not responsible for delays to the extent caused by events outside our reasonable control, including severe weather, natural disasters, carrier disruptions, government action, or widespread service outages. We will use reasonable efforts to reduce the effects and communicate material delays.
Such events do not eliminate an obligation to pay an agreed purchase price or excuse a failure to exercise reasonable care over devices in our possession.
21. Governing Law and Disputes
These Terms are governed by Pennsylvania law and applicable federal law, subject to mandatory protections that cannot lawfully be waived.
Please contact support with your order number and a description of any dispute so we can attempt to resolve it. This does not prevent you from contacting a regulator or bringing a claim in a court with proper jurisdiction and venue, including an appropriate small-claims court.
22. Changes and General Provisions
We may update these Terms for future orders. The version accepted when you submit an order governs that order unless a change is separately agreed to or required by law.
These Terms, the condition requirements accepted for the order, and any expressly agreed transaction-specific terms constitute the agreement concerning your submission. A specific written agreement controls over inconsistent general provisions to the extent permitted by law.
If a provision is unenforceable, the remainder continues to apply to the extent possible. Not enforcing a provision on one occasion does not waive future enforcement.
You may not assign your agreement without our written consent. We may use service providers or assign the agreement in a lawful business transfer without reducing your existing rights. Provisions intended by their nature to continue after a transaction remain effective.
